This is to advise all Center
Directors that all staff must receive a 30
minute uninterrupted meal period. There has
been litigation recently and over the years
regarding this situation. The most recent
decision was handed down in June of 2005. The
agency was remanded to pay each employee one
half hour of overtime for a period of two
years. The monies that were expended on this
case amounted to well over $40,000. It is
absolutely necessary that all staff on all
shifts receive an uninterrupted meal period. In
the case of an emergency situation, the meal
period must be extended allowing a total of 30
minutes without an interruption.
This may take scheduling the meal periods on the supervisors part. It is strongly suggested that staff and supervisors work out a schedule that is agreeable with all parties. Please keep your union representatives involved in the scheduling process as this could be a change in working conditions.
